These Terms & Conditions ("Terms") govern your use of the MindBlink app and related services ("MindBlink"). By downloading or using MindBlink, you agree to these Terms. If you don't agree, please don't use the app.

Your license to use MindBlink

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use MindBlink on Apple devices you own or control, in accordance with the Apple Media Services Terms and the Usage Rules in the App Store Terms of Service.

No account required

MindBlink does not require you to create an account. Where the app syncs your content, it does so through your own Apple ID and iCloud, which are governed by your agreement with Apple. You are responsible for the security of the Apple device and iCloud account you use with MindBlink.

Your content

The thoughts, recordings, and other material you create in MindBlink ("Your Content") belong to you. We do not claim ownership of Your Content. Because MindBlink stores Your Content on your device and in your private iCloud, you are responsible for maintaining your own backups (for example, via iCloud and standard device backups). We are not able to recover content that is lost due to device failure, deletion, or changes to your iCloud settings.

Acceptable use

You agree not to:

• Use MindBlink for any unlawful purpose or in violation of any applicable law or regulation;
• Attempt to reverse-engineer, decompile, or extract source code from the app except to the extent permitted by law;
• Interfere with or disrupt the integrity or performance of the app; or
• Use MindBlink to capture, store, or distribute content that infringes the rights of others.

Purchases & subscriptions

MindBlink may offer optional paid features or subscriptions. Any purchases are processed by Apple through the App Store and are subject to Apple's terms. Subscription prices, billing periods, and features are presented to you at the point of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; you can manage or cancel subscriptions in your Apple ID settings. Except where required by law, payments are non-refundable; refund requests are handled by Apple.

Availability & changes

We work hard to make MindBlink reliable, but we don't guarantee that it will always be available, uninterrupted, or error-free. We may update, add, or remove features over time, and we may modify these Terms; when we make material changes, we'll update the date above. Continued use after changes take effect constitutes acceptance.

Disclaimers

MindBlink is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MindBlink helps you capture and resurface thoughts and reminders, but it is not a substitute for your own judgment. Do not rely on it as the sole mechanism for safety-critical, medical, legal, or financial reminders. Reminder delivery depends on iOS, your device settings, notification permissions, and system conditions outside our control.

Limitation of liability

To the maximum extent permitted by law, MindBlink and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) MindBlink. To the extent liability cannot be excluded, it is limited to the amount you paid for the app, if any, in the twelve months preceding the claim.

Termination

You may stop using MindBlink at any time by deleting the app. We may suspend or terminate your license if you materially breach these Terms. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

Governing law

These Terms are governed by the laws of the jurisdiction in which the app's publisher is established, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection rights you have where you live.
